Rape prison or jail rape is the rape that took place in the prison. The phrase has been commonly used to refer rape to inmates by other inmates, and infrequent rape of inmates by staff, and even more rarely rapes staff by inmates.

In the US, the majority of cases are men raped by other men.

In some jurisdictions, sexual contact with inmates by prison staff is illegal without consent.

A famous teardrop tattoo sometimes signifies that the wearer was raped while imprisoned and tattooed with teardrops under the eyes by the offending party, this is a way of "marking" a prisoner as a property or publicly embarrassing a prisoner as a face tattoo can not be hidden.

Public awareness of the public prison rape is a relatively recent development and its prevalence estimates have varied considerably over the past few decades. In 1974, Carl Weiss and David James Friar wrote that 46 million Americans would one day be locked up; of that amount, they claim that 10 million will be raped.

A United States Justice Department report, Sexual Victims in Prisons and Prisons Report by Prisoners , states that "In 2011-12, it is estimated 5.0% of state and federal prisoners and 3.2% of inmates prisoners reported experiencing one or more incidents of sexual victimization by prisoners or other facility staff within the past 12 months or from entry into the facility, if less than 12 months. "However, supporters debate the accuracy of the figures, saying they appear to be less reporting the actual number of sexual assaults in prisons, especially among teenagers.

The 1992 estimate of the Federal Prisons Bureau estimates that between 9 and 20 percent of inmates have been sexually assaulted. Studies in 1982 and 1996 concluded that the figure was between 12 and 14 percent. A 1986 study by Daniel Lockwood mentions a figure of about 23 percent for the maximum security prison in New York. In contrast, Christine Saum's 1994 survey of 101 inmates showed 5 people had been sexually abused.

The Prison Rape Elimination Act of 2003 is the first US federal law to specifically deal with sexual assault on detainees. The bill was signed into law on September 4, 2003.

Iran

Sexual violence against political prisoners is prevalent in Iran. This is allegedly ignored or even facilitated by the authorities.

It is said that rape has been used by interrogators in Iran for decades. During the 1980s, after the Islamic Revolution of Iran, the rape of female political prisoners was so prevalent that it prompted Hussein-Ali Montazeri, Supreme Vice Chief Ayatollah Khomeini, to write the following letter to Khomeini in a letter dated October 7, 1986: "Did you know that young women were raped in some prisons in the Islamic Republic? In the 2009 Iranian presidential election protests, opposition groups reported thousands arrested and tortured in prisons across the country, with former inmates exposing the mass rapes of men, women and children by Islamic Revolutionary Guards, in prisons like Kahrizak and Evin.

After the 2009 presidential election, Iranian presidential candidate Mehdi Karroubi said several protesters held behind bars in the Evin Prison had been violently raped, according to a secret letter to cleric Akbar Hashemi Rafsanjani. Karroubi says this is a "snippet" of the evidence he has and that if the rejection does not stop, he will release more.

On August 9, 2009, in a letter to the Chairman of the Board of Acumen of Iranian Progress, Mehdi Karroubi demanded an investigation of Iran's jails for possible torture and, in particular, sexual harassment of men and women. On August 19 he wrote to parliament speaker Ali Larijani, requesting to meet him, President Mahmoud Ahmadinejad, the head of Ayatollah Sadeq Larijani, former president Akbar Hashemi Rafsanjani and state prosecutors to "personally present my documents and evidence of sexual cases "Ali Larijani and Sadeq Larijani (Judicial Committee) officially rejected his claims and representatives of Ali Khamenei, and Vice Chairman of the National Security Commission of parliament demanding the arrest of Karroubi.

Turkish

Human Rights Watch and Amnesty International have released reports of widespread rape and abuse of prisoners in Turkey for decades. Kurdish detainees are also specifically targeted for rape and other forms of sexual violence.
